At Andes Touring, we understand that unforeseen events can impact even the
best-laid plans. That’s why we’ve designed our terms and conditions to offer you
flexibility and fairness, while ensuring the continuity of our services.

1.1 Reservation process

Once the service quotation is accepted, the client must make the corresponding payment for their reservation according to the following conditions:

For products of 1 to 2 days of duration:

Once the payment is confirmed, Andes Touring will send the reservation confirmation. We are not responsible for any travel expenses incurred prior to this confirmation.

  • From the confirmation date, the client will have 7 calendar days to complete their registration form and digitally sign the required documents.
  • Minors (younger than 18) must have the signature of their legal guardians.
  • The client must provide truthful and up-to-date personal information, taking responsibility for notifying us of any relevant changes.

1.2 Payment methods and remaining balance

The client can make the payment using the methods enabled by Andes Touring (bank transfer, credit card, etc.).

Reservations made with a partial deposit must complete the full payment 30 or 90 days before the activity starts, depending on the product contracted. Failure to pay the remaining balance will result in the cancellation of the reservation without a refund.

2.1 Cancellations by the Client

The client may cancel their reservation for any reason they deem appropriate. Any cancellation by the client must be made explicitly via email to trips@andestouring.com. The date of receipt of this email by Andes Touring will determine the refund amount as follows:

  • Refunds will be made only to the same account from which the payment was made. Any costs associated with the refund transaction will be borne by the client.

For cancellations that qualify for a refund of 50% or more, the client may choose to retain 100% of the total amount as credit, under the following conditions:

  • Personal and non-transferable: The credit will be registered under the name of the reservation holder and cannot be transferred to third parties.
  • Expiration: The credit can be used within 18 months from the original activity start date. After this period, it will expire and will not be refundable or transferable.
  • Use of the credit: It can be applied to change the date of the same activity (subject to availability) or used for another product or service from Andes Touring (subject to availability).
  • Price differences: If the new service has a higher cost, the client must pay the difference. If the new service has a lower cost, the difference will not be refunded to the client.

No refunds will be made outside of the conditions stated above. In the case of illness, injury, or any other cause that results in the interruption or abandonment of the activity before or after its start, no type of refund will be granted.

2.2 Cancellations by Andes Touring

If Andes Touring cancels an activity for operational or logistical reasons, and not due to force majeure, a 100% refund of the amount paid will be issued to the client.

2.3 Cancellations due to force majeure

2.3.1 Cancellations due to Mountain Safety, Weather, Snow, and/or Avalanche Conditions

Andes Touring will do its best to adapt the activity to the existing conditions, possibly modifying the itinerary or location in order to meet the general objectives of the activity.

If the conditions do not allow the activity to continue and Andes Touring decides to cancel it, the following criteria will apply:

Productos of 1 or 2 days Rescheduling or extending the activity will be prioritized. If this is not possible, a proportional refund will be issued for the canceled time. Rescheduling the activity will be prioritized. If this is not possible, 95% of the total amount will be refunded.
Products of 3 or more days A partial refund will be offered according to what was agreed upon in each tour. Rescheduling the activity will be prioritized. If this is not possible, 95% of the total amount will be refunded.

2.3.2 Cancellations due to Other Causes of Force Majeure

Andes Touring may cancel an activity, either partially or entirely, due to force majeure reasons such as: earthquakes, volcanic eruptions, tsunamis, floods, avalanches, mudslides, fires, storms, epidemics, border closures, political conflicts, armed conflicts, wars, social protests, terrorist activity, and road closures. This list is for reference and not exhaustive.

  • Andes Touring will not be responsible for any additional expenses the client may incur (such as transportation, accommodation, or others).
  • A mutual agreement will be sought with the client, prioritizing the extension or rescheduling of the activity.
  • If an agreement cannot be reached, a refund will be offered, which will be calculated to benefit the client without Andes Touring incurring financial losses due to the cancellation.

3.1 Fitness and Technical Level Requirements

Before booking, the client must ensure that all participants included in their reservation meet the necessary fitness and technical level requirements for the activity. In case of doubts, they should consult with Andes Touring to confirm if their condition and level are suitable.

Each participant must:

  • Be in optimal health condition to participate in the activity.
  • Complete and submit a health declaration before the activity starts. If they have any special medical conditions, they must provide a medical authorization allowing them to participate.

3.2 Right of Admission and Exclusion of Participants

Andes Touring reserves the right to:

  • Recommend an alternative activity if the participant does not meet the physical, technical, or medical requirements.
  • Reject the participation of anyone who does not meet these requirements.
  • Partially or fully exclude any participant from the activity who:
    • Does not meet the required physical, technical, or medical requirements.
    • Has omitted relevant information in their health declaration.

In case of exclusion, there will be no right to a refund, and Andes Touring will not assume any additional costs resulting from the participant’s early departure.

3.3 Insurance

All participants will be required to present proof of medical coverage that includes the activities associated with the contracted product.

Additionally, Andes Touring strongly recommends purchasing:

  • Travel insurance that includes trip cancellation.
  • Emergency evacuation insurance.

For those who require it, Andes Touring will provide information on available insurance options.

Some activities may include insurance, which will be explicitly indicated in the product description.

Andes Touring will not cover any costs related to cancellations, evacuations, or medical expenses of the participants, without exceptions.

4.1 Responsibility of Andes Touring

Andes Touring is committed to providing services in accordance with its safety and quality standards, with a focus on excellence and continuous improvement. To achieve this, it trains its staff and applies all available tools to mitigate risks and deliver the highest quality service possible.  

  • Andes Touring will assume the costs associated with resolving issues arising from poor planning or inadequate execution of its responsibilities. However, it is not responsible for the failure of services provided by third-party suppliers, such as hotels, airlines, or others.  
  • Additionally, Andes Touring is not responsible for theft, damage, or loss of luggage and personal items, nor for injuries resulting from conditions outside of its control, including weather events or individual decisions made by the client during the activity.  
  • Furthermore, Andes Touring cannot guarantee snow quality or weather conditions during the activity.

4.2 Assumption of Risks by the Client

By booking a guided activity with Andes Touring, the client acknowledges and accepts that the activities involve inherent risks, including the possibility of severe injury or even death.

  • The client understands that the guides will do everything possible to minimize risks, but these cannot be completely eliminated in high-risk activities. To allow the guides to fulfill their mitigation duties, the client agrees to follow their instructions and guidelines at all times.
  • Except in cases of death or personal injury caused by gross negligence on the part of the guides, neither the guides nor any member of the Andes Touring team will be responsible for illness, injury, death, loss, or material damage that the client may suffer during the activity. They will also not be held liable for the failure to obtain appropriate insurance by the client.
  • If the client engages in illegal actions or behavior that endangers the safety of the group, they will be excluded from the activity. Andes Touring reserves the right to contact the relevant authorities and will not assume responsibility for the costs associated with their removal from the activity, legal assistance, or other related expenses.

5.1 Changes by Andes Touring

The client understands that enrolling in an Andes Touring program does not guarantee the fulfillment of specific sports objectives, such as reaching summits, completing itineraries, or following predetermined routes, as various factors inherent to the activity may prevent this. Likewise, the duration of activities may vary depending on the group’s safety.

  • Andes Touring reserves the right to modify destinations, activities, accommodations, and other associated services to ensure the continuity of the activity, always striving to offer an experience of equal or better quality than originally promised.
  • If part of the group and/or other groups in the same area require medical assistance or evacuation, the guides in charge and the clients must collaborate within their capacities and knowledge. If this results in an itinerary modification, no refunds will be issued.

5.2 Modifications Requested by the Client

  • Once the reservation has been made, if the client wishes to modify their itinerary, they must contact Andes Touring in a timely manner to evaluate the feasibility of the changes. Depending on the advance notice and nature of the request, cancellation or rescheduling fees may apply in accordance with the refund policy.
  • While Andes Touring does not guarantee the possibility of modifying itineraries at the client’s request, it commits to making every reasonable effort to accommodate such requests. Any costs arising from these changes will be the sole responsibility of the client.

By enrolling in any Andes Touring program, the client explicitly consents to the use of their personal image through photographic and audiovisual recordings, which may be used by Andes Touring as needed, primarily for the promotion of its products on digital media.

  • If the client has any complaints during the activity, they must immediately communicate them to the guide in charge and/or the Andes Touring office. This will allow an attempt to find a solution at the moment, if possible.
  • Additionally, the client may submit complaints to the company through the available communication channels listed at the bottom of this document.
  • In case of disputes, both parties agree to resolve the conflict through an external arbitrator before resorting to legal action.
  • Andes Touring’s official address for its activities is established in Santiago, Chile, which is also declared as the official legal domicile. Any legal action must be resolved under the laws and jurisdiction of the Republic of Chile.
